At the time of the making of the promise the eldest child was about fourteen years old: - Held, that this agreement was not one "not to be performed within a year from the making thereof," within the meaning of the Statute of Frauds, s.4, and was therefore binding, though made by parol only. Per Bramwell and Pigott, Bb.: - the agreement was one which might at any time have been terminated by either party giving notice to the other. The claim in a declaration may be amended, under the Common Law Procedure Act, 1852, s. 222, by the judge at the trial.
