Book excerpt: In light of a lack of comparable data on the respect, protection and fulfilment of the fundamental rights of lesbian, gay, bisexual and transgender (LBGT) persons, the EU Agency for Fundamental Rights launched in 2012 its online survey of LGBT persons' experiences of discrimination, violence and harassment. The survey results provide valuable evidence of how LGBT persons in the EU and Croatia experience bias-motivated discrimination, violence and harassment in different areas of life, including employment, education, healthcare, housing and other services. The findings show that many hide their identity or avoid locations because of fear. Others experience discrimination and even violence for being LGBT. Most, however, do not report such incidents to the police or any other relevant authority. By highlighting and analysing the survey results, this report, together with the accompanying EU LGBT survey main results report, will assist the EU institutions and Member States in identifying the fundamental rights challenges facing LGBT people living in the EU and Croatia. It can thereby support the development of effective and targeted European and national legal and policy responses to address the needs of LGBT persons and ensure the protection of their fundamental rights.

Book excerpt: Many people in Europe are stigmatised because of their sexual orientation or gender identity and cannot fully enjoy their universal human rights. Some of them are victims of violence, others have fled to Europe from countries where they risk being persecuted. Organisations representing lesbian, gay, bisexual and transgender (LGBT) persons have been denied registration or banned from organising peaceful meetings in some states in Europe. Too few politicians have taken a firm stand against homophobic and transphobic expressions, discrimination and violence. This report presents the results of the largest socio-legal study ever carried out on discrimination on grounds of sexual orientation and gender identity in the 47 member states of the Council of Europe. Six thematic chapters give a broad overview of the human rights situation of LGBT persons and recommendations are provided for developing and implementing effective measures to address discrimination. The report is intended as a tool for dialogue with authorities and other stakeholders. It constitutes a baseline study for further action in both legislative and policy fields to ensure that all LGBT people can effectively exercise their human rights.

Available in PDF, EPUB and Kindle. Book excerpt: The Globalisation of Hate: Internationalising Hate Crime? is the first book to examine the impact of globalisation on our understanding of hate speech and hate crime. Bringing together internationally acclaimed scholars with researchers, policy makers and practitioners from across the world, it critically scrutinises the concept of hate crime as a global phenomenon, seeking to examine whether hate crime can, or should, be conceptualised within an international framework and, if so, how this might be achieved. Beginning with the global dynamics of hate, the contributions analyse whether hate crime can be defined globally, whether universal principles can be applied to the phenomenon, how hatred is spread, and how it impacts upon our global society. The middle portion of the book moves beyond the broader questions of globalisation to jurisdictional examples of how globalisation impacts upon our understanding of, and also our responses to, hate crime. The chapters explore in greater detail what is happening around the world and how the international concepts of hate crime are being operationalised locally, drawing out the themes of globalisation and internationalisation that are relevant to hate crime, as evidenced by a number of jurisdictions from Europe, the US, Asia, and Africa. The final part of the book concludes with an examination of the different ways in which hate speech and hate crime is being combatted globally. International law, internet regulation and the use of restorative practices are evaluated as methods of addressing hate-based conflict, with the discussions drawn from existing frameworks as well as exploring normative standards for future international efforts. Taken together, these innovative and insightful contributions offer a timely investigation into the effects of hate crime, offering an interdisciplinary approach to tackling what is now a global issue. It will be of interest to scholars and students of criminology, sociology and criminal justice, as well as criminal justice practitioners, police officers and policy makers. 1 ‘ Test " test.

Book excerpt: "Violence against women undermines women's core fundamental rights such as dignity, access to justice and gender equality. For example, one in three women has experienced physical and/or sexual violence since the age of 15; one in five women has experienced stalking; every second woman has been confronted with one or more forms of sexual harassment. What emerges is a picture of extensive abuse that affects many women's lives but is systematically underreported to the authorities. The scale of violence against women is therefore not reflected by official data. This FRA survey is the first of its kind on violence against women across the 28 Member States of the European Union (EU). It is based on interviews with 42,000 women across the EU, who were asked about their experiences of physical, sexual and psychological violence, including incidents of intimate partner violence ('domestic violence'). The survey also included questions on stalking, sexual harassment, and the role played by new technologies in women's experiences of abuse. In addition, it asked about their experiences of violence in childhood. Based on the detailed findings, FRA suggests courses of action in different areas that are touched by violence against women and go beyond the narrow confines of criminal law, ranging from employment and health to the medium of new technologies."--Editor.

Available in PDF, EPUB and Kindle. Book excerpt: The Covid-19 pandemic has revealed how far we as a European society still are from the proclaimed Union of Equality. The book explores how the promise of equal treatment can become a reality and compliance with the EU acquis relating to equality and non-discrimination can be improved. It studies enforcement and promotion aspects of the two watershed directives of 2000, the Racial Equality Directive 2000/43/EC and the Employment Equality Directive 2000/78/EC, through the lens of reflexive governance. This governance approach is proposed as having great potential in enhancing the likelihood of sustainability (or continuation) of reforms in the current candidate countries and EU Member States through its emphasis on reflexive learning processes and the cooperation between EU institutions, national authorities, and civil society actors. In order to deploy this potential, there is, however, a need for more consistent and transparent monitoring, both with regard to candidate countries as well as old and new Member States, and a reconsideration of the understanding of monitoring as such. It should be seen as helping to deconstruct own preference-formations and as a possibility to learn from successes and failures in a cooperative and recursive process. To work on these lacunae and improve learning and monitoring processes, this book identifies indicators, that are deduced from the comparative review of the implementation practice of the member states. This book is thus a contribution to the existing literature in the fields of Europeanization, governance, and the right to equality and non-discrimination.
