The election was designed to cap an often forestalled peace process defined by the 2007 Ouagadougou Political Agreement, the most recent in a series of partially implemented peace accords aimed at reunifying the country, which was divided between a government-controlled southern region and a rebel-controlled northern zone after a brief civil war in 2002. Ouattara based his victory claim on the U.N.-certified runoff results announced by the Ivoirian Independent Electoral Commission (IEC). These indicated that he had won the election with a 54.1% vote share, against 45.9% for Gbagbo. This book offers an in-depth examination of the effects of interventions by the ICC on peace, justice and conflict processes. The 'peace versus justice' debate, wherein it is argued that the ICC has either positive or negative effects on 'peace', has spawned in response to the Court's propensity to intervene in conflicts as they still rage. This book is a response to, and a critical engagement with, this debate. Building on theoretical and analytical insights from the fields of conflict and peace studies, conflict resolution, and negotiation theory, the book develops a novel analytical framework to study the Court's effects on peace, justice, and conflict processes. This framework is applied to two cases: Libya and northern Uganda. Drawing on extensive fieldwork, the core of the book examines the empirical effects of the ICC on each case. The book also examines why the ICC has the effects that it does, delineating the relationship between the interests of states that refer situations to the Court and the ICC's institutional interests, arguing that the negotiation of these interests determines which side of a conflict the ICC targets and thus its effects on peace, justice, and conflict processes. Hundreds of people have been unlawfully killed, often only on the grounds of their ethnicity or presumed political affiliation. Sexual violence, including rape, was reported, and hundreds of thousands of people were forced to seek refuge in other regions of Cote d'Ivoire or in neighboring countries, especially Liberia. Thousands of people remain displaced after fleeing the wave of human rights violations and abuses, which continued to be committed by both sides after the arrest of former President Laurent Gbagbo. Dozens were killed by pro-Gbagbo militiamen. At the same time, ethnic groups considered to be Gbagbo's supporters have received little or no protection from either the new security forces created by President Alassane Ouattara, or the peacekeeping forces of the United Nations Operation in Cote d'Ivoire (UNOCI). This report is based on research carried out in the city of Abidjan and in the west of the country between January and April 2011. The conclusions show that all parties to the conflict have committed crimes under international law, including war crimes and crimes against humanity.
