Available in PDF, EPUB and Kindle. Book excerpt: In To Protect and Maintain Individual Rights, Jonathan Bechtle and Michael Reitz provide a section by section analysis of the Washington Constitution's Declaration of Rights. The authors review the state's 1889 constitutional debates, contemporary accounts of the convention, and significant cases that have dealt with the rights guaranteed in the Washington Constitution. The book includes a foreword by Washington Supreme Court Justice Charles Johnson. A 2006 survey found that only twenty-five percent of Americans can name more than one freedom protected by the First Amendment. Twenty percent of those polled actually thought the right to own a pet was protected. Yet more than half of these adults could name at least two characters from a popular television cartoon. If familiarity with the U.S. Constitution is lacking, awareness of the provisions of the state constitution is deplorable. Bechtle and Reitz urge citizens to become familiar with their state constitution, as individual rights are often afforded greater protection from the state constitution than from the U.S. Constitution. “When citizens are educated in the sources of their freedoms, and familiar with attempts in history to limit these freedoms, they are better equipped to recognize new encroachments.”

Book excerpt: For more than 200 years, the Constitution of the United States has been a “working” document, maintaining the original principles upon which our nation was founded while, at the same time, changing with the country, as reflected in its amendments. While the U.S. Constitution itself outlines the basic structure of the federal government, its twenty-seven amendments address many subjects but primarily focus on the rights of individual American citizens. This booklet outlines those rights, offering historical context and other information that is both interesting and informative. The continued vitality of our democracy is dependent upon an informed citizenry. Understanding the history of the Constitution and its amendments will assist all of us in more fully appreciating these rights and responsibilities as they have evolved over time. Moreover, such understanding will ensure that these rights will continue to be exercised, valued, and cherished by future generations.

Book excerpt: The U.S. Constitution is a blueprint for a free society as well as a source of enduring conflict over how that society must be governed. The competing ways of reading our founding document shape the decisions of the Supreme Court, which acts as the final voice on constitutional questions. This breezy, concise guide explains the central conflicts that frame our constitutional controversies, written in clear non-academic language to serve as a resource for engaged citizens, both inside and outside of an academic setting. After covering the main points of conflict in constitutional law, Marietta gives readers an overview of the perspectives from the leading schools of constititional interpretation--textualism, common law constitutionalism, originalism, and living constitutionalism. He then walks through the points of conflict and competing schools of thought in the context of several landmark cases and ends with advice to readers on how to interpret constitutional issues ourselves.
