Book excerpt: Trafficking in people for prostitution and forced labor is one of the most prolific areas of international criminal activity and is of significant concern to the United States and the international community. The overwhelming majority of those trafficked are women and children. According to the most recent Department of State estimates, roughly 800,000 people are trafficked across borders each year. If trafficking within countries is included in the total world figures, official U.S. estimates are that some 2 to 4 million people are trafficked annually. However, there are even higher estimates, ranging from 4 to 27 million for total numbers of forced or bonded laborers. As many as 17,500 people are believed to be trafficked to the United States each year. Human trafficking is now a leading source of profits for organized crime syndicates, together with drugs and weapons, generating billions of dollars. Trafficking in persons affects virtually every country in the world. Since enactment of the Victims of Trafficking and Violence Protection Act of 2000 (P.L. 106-386), the Administration and Congress have aimed to address the human trafficking problem. The Trafficking Victims Protection Reauthorization Act of 2005 (TVPRA), which President Bush signed into law on January 10, 2006 (P.L. 109-164), authorized appropriations for FY2006 and FY2007. The State Department issued its eighth congressionally mandated Trafficking in Persons (TIP) Report on June 4, 2008. Each report categorizes countries into four tiers according to the government's efforts to combat trafficking. Those countries that do not cooperate in the fight against trafficking (Tier 3) have been made subject to U.S. sanctions since 2003. The group named in 2008 includes a total of 14 countries: Algeria, Burma, Cuba, Fiji, Iran, Kuwait, Moldova, North Korea, Oman, Papua New Guinea, Qatar, Saudi Arabia, Sudan, and Syria.

According to the International Labor Organization (ILO), some 20.9 million individuals today are estimated to be victims of forced labor and related TIP. As many as 17,500 people are believed to be trafficked into the United States each year, and some have estimated that 100,000 U.S. citizen children are victims of trafficking within the United States. Overall, issues related to U.S. anti-TIP efforts include the effectiveness of current programs, whether there is duplication among these programs, and whether there is sufficient oversight of monies spent on anti-trafficking activities. Ongoing international policy issues include how to measure the effectiveness of the U.S. and international anti-TIP responses, the impact of U.S. Department of State's annual country rankings, and the use of unilateral aid restrictions. Domestic issues include whether there is equal treatment of all victims -- both foreign nationals and U.S. citizens, as well as victims of labor and sex trafficking; and whether current law and services are adequate to deal with the emerging issue of domestic child sex trafficking (i.e., the prostitution of children in the United States). Other overarching issues include whether all forms of prostitution (i.e., children and adults) fit the definition of TIP, and whether sufficient efforts are applied to addressing all forms of TIP, including not only sexual exploitation, but also forced labor and child soldiers.

TIP is believed to be one of the most prolific areas of contemporary criminal activity and is of significant interest to the United States as a serious human rights concern. TIP is both an international and domestic crime that involves violations of labor, public health, and human rights standards, as well as criminal law. The Trafficking Victims Protection Act (TVPA) is the primary law that addresses human trafficking. Domestically, anti- TIP efforts provided under the TVPA include protection for victims, the investigation and prosecution of trafficking offenses, and education of the public. Congress reauthorized the TVPA in March 2013 (Trafficking Victims Protection Reauthorization Act; Title XII of P.L. 113-4). While this report covers P.L. 113-4, a more complete treatment of that bill can be found in CRS Report RL34317, Trafficking in Persons: U.S. Policy and Issues for Congress. This report discusses TIP issues that have received legislative action or are of significant congressional interest in the 113th Congress.
