Available in PDF, EPUB and Kindle. Book excerpt: In 2012, at the height of the sovereign debt crisis, European decision makers pushed for developing an 'ever closer union' with the formation of a European Banking Union (BU). Although it provoked widespread debate, to date there has been no coherent discussion of the political and constitutional dimensions of the European Banking Union. This important new publication fills this gap. Drawing on the expertise of recognised experts in the field, it explores banking union from legal, economic and political perspectives. It takes a four-part approach. Firstly, it sets the scene by examining the constitutional foundations of banking union. Then in parts 2 and 3, it looks at the implications of banking union for European integration and for democracy. Finally it asks whether banking union might be more usefully regarded as a trade-off between integration and democracy. This is an important, timely and authoritative collection.

In wake of such turmoil a new banking union must enable better supervision, pre-emptive coordinated action and taxpayer protection. While these aims are meritorious they will be difficult to achieve. This book explores the potential of a new banking union in Europe. This book brings together leading experts to analyse the challenges of banking in the European Union. While not all contributors agree, the constructive criticism provided in this book will help ensure that a new banking union will mature into a stable yet vibrant financial system that encourages the growth of economic activity and the efficient allocation of resources. This book will be of use to researchers interested in Banking, Monetary Economics and the European Union.

Available in PDF, EPUB and Kindle. Book excerpt: This chapter looks at political and legal accountability in the European Banking Union. It is structured as follows. The discussion begins with a sketch of the constitutional structure and administrative machinery in the area of Banking Union. The focus then shifts to the concept of accountability, in an attempt to explain key concepts that will be used in this paper. This is followed by analysis of political accountability in the Single Supervisory Mechanism and the Single Resolution Mechanism, which are the main building blocks of the Banking Union thus far. The paper examines the respective roles of the European Parliament, Council, Eurogroup and national parliaments in holding the Banking Union actors accountable for the exercise of their duties. The penultimate section of the chapter concerns internal administrative review of supervisory measures and resolution actions, which is carried out by the Administrative Board of Review and the Appeal Panel respectively, as well as review by the Court of Justice of the European Union and national courts. The final section of the chapter glimpses briefly the vexed issue of the European Central Bank's legitimacy in exercising supervisory tasks over banks in the Euro area (and potentially beyond).

Book excerpt: The establishment of Banking Union represents a major development in European economic governance and European integration history more generally. Banking Union is also significant because not all European Union (EU) member states have joined, which has increased the trend towards differentiated integration in the EU, posing a major challenge to the EU as a whole and to the opt-out countries. This book is informed by two main empirical questions. Why was Banking Union - presented by proponents as a crucial move to 'complete' Economic and Monetary Union (EMU) - proposed only in 2012, over twenty years after the adoption of the Maastricht Treaty? Why has a certain design for Banking Union been agreed and some elements of this design prioritized over others? A two-step explanation is articulated in this study. First, it explains why euro area member state governments moved to consider Banking Union by building on the concept of the 'financial trilemma', and examining the implications of the single currency for euro area member state banking systems. Second, it explains the design of Banking Union by examining the preferences of member state governments on the core components of Banking Union and developing a comparative political economy analysis focused on the configuration of national banking systems and varying national concern for the moral hazard facing banks and sovereigns created by euro level support mechanisms.

Based on an analysis of how national courts reviewed the crisis response mechanisms and participated in the European-level political process, Tomi Tuominen argues that constitutional pluralism is not a valid normative theory of European constitutionalism.

Book excerpt: This book compares the different expressions of, and outcomes from, banking nationalism in two European countries to draw wider conclusions about the consequences for Banking Union in Europe and to show how national governments deal (or fail to deal) with international commitments. It reveals how and why one case – Spain – managed to tackle failing banks within EU Banking Union regulations even before they became written in EU law, while the other – Italy – had more persistent problems. The book argues that Spain demonstrates a successful case of liberal economic nationalism, typified by aggressive, early state intervention to restructure Spanish banks, and help from the European Stability Mechanism even in the face of local political opposition. Italy, meanwhile, suffered from the weaker, delayed intervention which forced it to confront European institutions with demands for special treatment as a means of externalizing its own internal weakness. This book will be of key interest to scholars, students and professionals in economic policy, Economic and Monetary Union and Banking Union in Europe, European and global governance, European/EU studies, European public policy, European public administration and EU law, as well as professionals working in the banking sector.

Book excerpt: The author provides a thought-provoking account of the role of the European Central Bank (ECB) in the European constitutional order. He briefly outlines the history of the debate on the future of European governance and examines the current constitutional position of the ECB. He then sets out what the application is of general Community law to the ECB, and the current proposals for constitutional change, both in the application of the Treaty of Nice and in the context of the current constitutional European Convention. He concludes by offering an inspiring contribution to the wider constitutional debate. The text of this book provided the basis for a lecture given by the author on accepting the Jean Monnet Chair of the Law of the Economic and Monetary Union at the Faculty of Law of the University of Amsterdam on 4 June 2003.

Book excerpt: The financial crash and lengthy economic recession have tested the institutions of the European Union as never before. Debate about the future of Europe has polarized: Some want no more integration; others campaign for disintegration. Those who believe in deeper unity and a stronger federal Europe have yet to make their case. "A Fundamental Law" does that by offering a prospectus for radical reform. It amends the Lisbon Treaty to make the government of the EU more powerful and democratic. It embraces banking and fiscal union while showing the way forward to a legitimate settlement of Europe's constitutional dilemma. Ten years after the Convention on the Future of Europe proposed its constitutional treaty, the Spinelli Group of federalist MEPs has drafted comprehensive proposals for an ambitious new treaty. Anyone who wonders how a more united Europe should best be governed should read this. The members of the next Convention will.
