Book excerpt: A radical case for the repeal of the 2nd Amendment as the only way to control gun violence in America There's an average of one mass shooting per day in the United States. Given the ineffectiveness of the gun control lobby, it's time for a strategy with spine. In Repeal the Second Amendment, Allan J. Lichtman has written the first book that uses history, legal theory and up-to-the-minute data to make a compelling case for the amendment’s repeal in order to create a clear road to sensible gun control in the US. Repeal the Second Amendment explores both the true history and current interpretation of the Second Amendment to expose the NRA’s blatant historical manipulations and irresponsible fake news releases. Lichtman looks at the history of firearms and gun regulations from colonial times to the present to explain how a historically forgotten sentence in the Constitution has become a flash point of recent politics that benefits only the gun industry, their lobbyists, and the politicians on their payroll. He probes court decisions and the effective lobbying and public relations strategies of the gun lobby as well as the ineffectiveness of the gun control movement for lessons in doing better. What emerges is a clear and cogent plan--repeal and replace the Second Amendment without taking guns away from anyone who has them now--to make the US a safer place. It's time to Repeal the Second Amendment, and Allan Lichtman is the man to bring this radical plan to America.

Book excerpt: Over two hundred years ago, the United States enacted a constitutional amendment ensuring the ability of states to form militias. Although the militia has become obsolete, over 30,000 Americans die every year by gunfire. Both pro-gun and pro-control advocates put forth credible proposals for reducing gun violence, but all too often this public policy debate gets sidetracked by invocation of the Second Amendment right to bear arms, which improperly makes a constitutional issue out of a public policy matter. This book argues for the repeal of the Second Amendment because this amendment no longer serves its original constitutional purpose, and it disrupts the contemporary gun debate.

Book excerpt: Finalist, ABA Silver Gavel Award for Books The New York Times bestseller that has cemented Elie Mystal’s reputation as one of our sharpest and most acerbic legal minds “After reading Allow Me to Retort, I want Elie Mystal to explain everything I don’t understand—quantum astrophysics, the infield fly rule, why people think Bob Dylan is a good singer . . .” —Michael Harriot, The Root Allow Me to Retort is an easily digestible argument about what rights we have, what rights Republicans are trying to take away, and how to stop them. Mystal explains how to protect the rights of women and people of color instead of cowering to the absolutism of gun owners and bigots. He explains the legal way to stop everything from police brutality to political gerrymandering, just by changing a few judges and justices. He strips out all of the fancy jargon conservatives like to hide behind and lays bare the truth of their project to keep America forever tethered to its slaveholding past. Mystal brings his trademark humor, expertise, and rhetorical flair to explain concepts like substantive due process and the right for the LGBTQ community to buy a cake, and to arm readers with the knowledge to defend themselves against conservatives who want everybody to live under the yoke of eighteenth-century white men. The same tactics Mystal uses to defend the idea of a fair and equal society on MSNBC and CNN are in this book, for anybody who wants to deploy them on social media. You don’t need to be a legal scholar to understand your own rights. You don’t need to accept the “whites only” theory of equality pushed by conservative judges. You can read this book to understand that the Constitution is trash, but doesn’t have to be.

Book excerpt: Seminar paper from the year 2019 in the subject American Studies - Culture and Applied Geography, grade: 1,7, University of Bonn, language: English, abstract: This study is concerned with the historical development of the Second Amendment and how it is interpreted today. In doing so, John Vile's "A Companion to the United States Constitution and its Amendments" and Adam Winkler's "Gun Fight" have been consulted to provide background information on the history of the Second Amendment. Due to the fact that this term paper also deals with current statistics on gun control laws, it also relied on online research and online publications. Firstly, there will be a chapter that deals with the original intent of the founding fathers, who framed the Second Amendment to the United States Constitution. It will provide an historical overview of the creation of the Second Amendment and what led to its inclusion into the Bill of Rights. It further tries to explain the founder's interpretation of the Second Amendment with regards to the militia. The third chapter will focus on the question of how the National Rifle Association was able to rewrite the Second Amendment in order to gain more profit and get support for gun rights. The chapter will present the approach taken by the NRA that resulted in a new interpretation of the Second Amendment and established the perception of an individual right to possess firearms within American society. It will take into account the Supreme Court cases of "United States v. Miller" of 1939 and "District of Columbia v. Heller" of 2008, that ultimately guaranteed an individual's right to own firearms without any connection to a militia. Another chapter will focus on gun control laws and provide a comparison between the United States and other developed countries. Furthermore, this chapter will give an insight into the perception of the Second Amendment within American society and discusses current gun control policies. Finally, the last paragraph of this term paper will be a conclusion, which sums up the results achieved and gives an outlook for future research on the Second Amendment and gun control laws.

Book excerpt: Historically, the rights that individual Americans enjoy have also benefited the country as a whole. But the right to bear arms has become destructive of our society and a threat to all of our other rights. This book examines the ugly pro-slavery and genocidal origins of the Second Amendment and the resentment, anger, and profit motives that fuel today's pro-gun culture. It offers a practical solution to the problem of gun violence. "Lee Goodman provides a sweeping analysis of the history behind the Second Amendment to the U.S. Constitution, the rise of the gun culture in the U.S., and the campaign of fear orchestrated by pro-gun lobbies. His challenge is equally bold: Repeal the Second Amendment as the chief obstacle to the development of appropriate gun laws. Read this book. It just might save your life or that of someone you love." - Charles R. Strain, Professor of Religious Studies, DePaul University "Chicago and the nation continue to be under siege with the easy access to guns and the bullying of the NRA. Lee Goodman has been on the front lines trying to help save lives." - Rev. Michael L. Pfleger, Pastor, Faith Community of St. Sabina "Anyone sick and tired of the epidemic of gun violence across America needs to give this book a close read and seriously grapple with its ideas and the call to action for citizens to reclaim control of our democracy." - Ilya Sheyman, Executive Director, MoveOn.org Political Action

Available in PDF, EPUB and Kindle. Book excerpt: For the first time ever, a retired Supreme Court Justice offers a manifesto on how the Constitution needs to change. By the time of his retirement in June 2010, John Paul Stevens had become the second longest serving Justice in the history of the Supreme Court. Now he draws upon his more than three decades on the Court, during which he was involved with many of the defining decisions of the modern era, to offer a book like none other. Six Amendments is an absolutely unprecedented call to arms, detailing six specific ways in which the Constitution should be amended in order to protect our democracy and the safety and wellbeing of American citizens. Written with the same precision and elegance that made Stevens's own Court opinions legendary for their clarity as well as logic, Six Amendments is a remarkable work, both because of its unprecedented nature and, in an age of partisan ferocity, its inarguable common sense.
