Using texts from European and Indigenously-informed sources, Steven Wagschal argues that people tend to conceptualize the minds of animals in ways that reflect their own uses for the animal, the manner in which they interact with the animal, and the place in which the animal lives. Often this has little if anything to do with the actual cognitive abilities of the animal. However, occasionally early authors made surprisingly accurate assumptions about the thoughts and feelings of animals. Wagschal explores a number of ways in which culture and human cognition interact, including: the utility of anthropomorphism; the symbolic use of animals in medieval Christian texts; attempts at understanding the minds of animals in Spain's early modern farming and hunting books; the effect of novelty on animal conceptualizations in "New World" histories, and how Cervantes navigated the forms of anthropomorphism that preceded him to create the first embodied animal minds in fiction.

Book excerpt: The rise of the globalized economy has rendered an even more profound change in the relationship between humans and other animals than the ancient progression from huntergatherer to agricultural society. In today’s global markets, multinational corporations exploit the economic value of animals throughout the world on an unprecedented scale. The philosophical and legal notions that animals are mere unfeeling machines or pieces of property, although more or less taken for granted for centuries, has been challenged, if not burst asunder, in recent decades (in law, moral philosophy, and cognitive and other sciences), and regulation of the treatment of animals in agriculture, experimentation, entertainment and other areas has begun to make substantial inroads in national and international law. This book provides a detailed analysis of international and comparative animal law focusing on the impact of today’s globalized economy on animal law. Describing a wide range of domestic and international laws relating to the treatment of animals, the author explicates the sorts of legal rules which affect the global animal marketplace. Representative norms in existing animal protection laws are analyzed and critiqued, illustrating the diverse approaches taken by different countries and by the international community in regulating uses of animals. Studies pertaining to dog minds have been pouring out of canine cognition labs all over the world, but they remain relatively ensconced within the scientific, sociological, and anthropological communities. Besides dogs, researchers have also been probing the minds of octopi, fish, and crows, and indeed, several philosophers have weighed in on these findings. Nevertheless, very little philosophical thought on dog cognition exists. Philosophers certainly have not shied away from theorizing about the nature of non-human animal cognition generally. Theories range from Cartesian disavowal of all non-human intelligence to arguments that even fish have complex minds and therefore, humans should not eat them. Serious philosophical considerations about dogs and their relationship to humans, however, remain incredibly rare.
