Available in PDF, EPUB and Kindle. Book excerpt: Magna Carta is among the most famous documents in the history of the world, credited with being the first effective check in writing on arbitrary, oppressive and unjust rule - in a word, on tyranny. The fame of Magna Carta spread as England, and later Britain, came to girdle the globe in its power. This volume is the first to examine the importance of Ireland in the story of Magna Carta's dissemination. Four centuries before Magna Carta crossed the Atlantic, it had already been implanted across the Irish Sea. A version of the charter, issued in November 1216 in the name of the boy-king Henry III, was sent to Ireland, where it became fundamental to the English common law tradition in Ireland that survives to the present. This volume - the proceedings of a conference marking the 800th anniversary of the transmission of Magna Carta to Ireland - explores the paradoxes presented by the reception of Magna Carta into Irish law, above all the contested idea of ? ? ? ? liberty' that developed in Ireland. Contributors examine the legal, political and polemical uses to which Magna Carta was put from the thirteenth century onwards, as well as its twentieth- and twentieth-first century invocations as a living presence in contemporary Irish law. The volume also includes a new edition and translation of the Magna Carta Hibernie ('The Great Charter of Ireland') - an adaptation of the 1216 issue of Magna Carta found in the Red Book of the Irish Exchequer, which was destroyed in 1922. Subjects: Irish History; Legal History; Magna Carta; Medieval History].

Book excerpt: The Roots of Liberty is a critical collection of essays on the origin and nature of the often elusive idea of the nature of liberty. Throughout this book, the original and thought-provoking views from scholars J C Holt, Christopher W Brooks, Paul Christianson, and John Phillip Reid offer insights into the development of English ideas of liberty and the relationship those ideas hold to modern conceptions of rule of law. Ellis Sandoz's introduction details Fortescue's vision of the constitution and places each of the essays in historiographical context. Corrine C. Weston's spirited epilogue evaluates the essays' arguments.

Book excerpt: The discussion of the norm of the rule of law has broken out of the confines of jurisprudence and is of growing interest to many non-legal researchers. A range of issues are explored in this volume that will help non-specialists with an interest in the rule of law develop a nuanced understanding of its character and political implications. It is explicitly aimed at those who know the rule of law is important and while having little legal background, would like to know more about the norm.

Book excerpt: A revised edition of J. C. Holt's classic study of Magna Carta, the Great Charter, offering the most authoritative analysis of England's most famous constitutional text. The book sets the events of 1215 and the Charter itself in the context of the law, politics and administration of England and Europe in the twelfth and thirteenth centuries. Additionally, a lengthy new introduction by two of Holt's former pupils, George Garnett and John Hudson, examines a range of issues raised by scholarship since publication of the second edition in 1992. These include the possible role of Archbishop Stephen Langton; the degree of influence of Roman and Canon Law upon those who drafted the Charter; other aspects of the intellectual setting of the Charter, in particular political thinking in London; the Continental context of the events of 1212–15; and the legal and jurisdictional issues that affected the Charter's clauses on justice.

Book excerpt: For the eight hundredth anniversary of the Magna Carta, the University of Virginia Press presents the first paperback edition of The Road from Runnymede by A. E. Dick Howard, originally published in 1968. In this volume, Howard explores the ways in which Magna Carta's concepts, most notably due process, have been absorbed and put into practice by English and especially American society. He goes on to show how the idea of constitutional government evolved in America, moving beyond the foundations laid by Magna Carta to adapt itself to the new republic's needs.
