Divided into two parts, the first deals explicitly with Sámi customary rights in relation to nature conservation in the Nordic countries and Russia from a legal and historical perspective. The authors investigate how longstanding Sámi customary territorial rights have been reassessed in the context of new kinds of legislation regarding Indigenous people. They also look at the ideas behind the historical models of nature conservation. The second part deals with the ideas and implementation of new kinds of postcolonial models of nature conservation. The case of the Sámi is compared with other Indigenous people internationally with cases from Australia, New Zealand, Canada and India. The work investigates how the governance of protected areas has been influenced by the principles of equality and positive discrimination, and how it has affected the possibilities of establishing adaptive co-management arrangements for specific areas. How the legal situation of Indigenous peoples has been recognised in an international context is also investigated. The volume provides a multidisciplinary analysis of how the customary livelihood of Indigenous people has adapted to modern industrialised landscapes and also how postcolonial approaches have contributed to global changes of Indigenous rights and nature conservation models.

Struggles for political recognition and cultural respect have occurred historically and continue to challenge Native American nations in Montana and Sámi people of northern Scandinavia in their efforts to remain and thrive as who they are as Indigenous peoples. In some ways the Indigenous struggles on the two continents have been different, but in many other ways, they are similar. Mapping Indigenous Presence presents a set of comparative Indigenous studies essays with contemporary perspectives, attesting to the importance of the roles Indigenous people have played as overseers of their own lands and resources, as creators of their own cultural richness, and as political entities capable of governing themselves. This interdisciplinary collection explores the Indigenous experience of Sámi peoples of Norway and Native Americans of Montana in their respective contexts—yet they are in many ways distinctly different within the body politic of their respective countries. Although they share similarities as Indigenous peoples within nation-states and inhabit somewhat similar geographies, their cultures and histories differ significantly. Sámi people speak several languages, while Indigenous Montana is made up of twelve different tribes with at least ten distinctly different languages; both peoples struggle to keep their Indigenous languages vital. The political relationship between Sámi people and the mainstream Norwegian government and culture has historically been less contentious that that of the Indigenous peoples of Montana with the United States and with the state of Montana, yet the Sámi and the Natives of Montana have struggled against both the ideology and the subsequent assimilation policy of the savagery-versus-civilization model. The authors attempt to increase understanding of how these two sets of Indigenous peoples share important ontological roots and postcolonial legacies, and how research may be used for their own self-determination and future directions.

Book excerpt: In 2005 an expert group representing the governments of Norway, Sweden and Finland, and the Saami parliaments of these countries agreed upon a draft text of a Nordic Saami Convention. Key parts of the text deal with the recognition of Saami land and resource rights. More recently the three governments have embarked on negotiations to move from this draft text to a final convention that may be adopted and ratified by all three countries. Negotiations commenced in the Spring of 2011 and should be completed within five years. This collection of essays explores the national and international dimensions of indigenous property rights and the draft Convention which recognises the Saami as one people divided by international boundaries. Part one of the book seeks to provide a global and theoretical context for these developments in the Nordic countries, with a series of essays dealing with the moral and legal reasons for recognising indigenous property interests and different conceptualisations of the relationship between indigenous peoples and settler societies, including recognition, reconciliation and pluralism. Part two of the book examines some international legal issues associated with the Convention, including the background to the Convention. Part three turns to examine aspects of the recognition of Saami property interests in each of the three Nordic states, while Part four provides some comparative experiences, examining the recognition of indigenous property rights in a number of jurisdictions, including Canada, Australia and a number of South American states. An additional essay considers gender issues in relation to indigenous property rights.
