Available in PDF, EPUB and Kindle. Book excerpt: DOD obligated $421.8 billion in fiscal year 2020 on contracts. GAO has long reported that DOD’s procurement processes are vulnerable to waste, fraud, and abuse. In 2018, DOD reported to Congress that from fiscal years 2013- 2017, over $6.6 billion had been recovered from defense-contracting fraud cases. In 2020, the DOD Office of Inspector General reported that roughly one-in-five of its ongoing investigations are related to procurement fraud. This report assesses the steps DOD took in fiscal year 2020 (1) to combat department- wide fraud risks and (2) to conduct a fraud risk assessment and ensure that DOD’s component organizations reported procurement fraud risks. GAO makes five recommendations, including that DOD fill all Task Force positions, update its policy to require fraud risk assessments, and ensure that components assess procurement fraud risks.

Available in PDF, EPUB and Kindle. Book excerpt: DOD generally accounts for about two-thirds of federal contracting activity. Some companies doing business with DOD may have an opaque ownership structure that conceals other entities or individuals who own, control, or financially benefit from the company. Opaque ownership could be used to facilitate fraud and other unlawful activity. This report identifies types of fraud and other risks that opaque contractor ownership poses to DOD in the procurement process and assesses whether DOD has taken steps to address those risks. This is a public version of a sensitive report that GAO issued in September 2019. Information that DOD deemed sensitive involving ongoing investigations and certain internal controls and vulnerabilities has been omitted. GAO recommends that DOD assess risks related to contractor ownership as part of DOD’s ongoing efforts to assess fraud risk. DOD should use this information to inform other types of risk assessments, including national security concerns.

This book was released on 2011 with total page 45 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report on contractor fraud was prepared by the Department of Defense at the direction of Congress. Congress directed the assessment to include the total value of DOD contracts entered into with contractors indicted for, settled charges of, been fined by the government for, or been convicted of fraud in connection with past transactions involving DOD or its components. Because there is no central repository for this data, DOD faced a number of challenges in developing this report. First and foremost was the development a common definition of 'procurement fraud.' Fraud is a broad category and DOD components were found to classify it differently. Additionally, it was discovered that the manner in which the data are reported differs. DOD's chief finding was that financial obligations to contractors convicted of fraud continued, in some cases, after their conviction.

While the emphasis of the handbook is toward contract auditors, the information may prove useful for all auditors. The 1988 revision to the Government Auditing Standards, issued by the Comptroller General of the United States, requires tests for compliance with applicable laws and regulations. The auditing standards require the auditor to design steps and procedures that provide a reasonable assurance of detecting errors, irregularities and illegal ads that could materially affect the financial related audits. The 1988 revision also significantly increased the auditor's responsibility, from remaining alert for fraud indicators to designing steps to reasonably assure detecting irregularities and illegal ads.

Available in PDF, EPUB and Kindle. Book excerpt: The Standards of Conduct Office of the Department of Defense General Counsel's Office has assembled an "encyclopedia" of cases of ethical failure for use as a training tool. These are real examples of Federal employees who have intentionally or unwittingly violated standards of conduct. Some cases are humorous, some sad, and all are real. Some will anger you as a Federal employee and some will anger you as an American taxpayer. Note the multiple jail and probation sentences, fines, employment terminations and other sanctions that were taken as a result of these ethical failures. Violations of many ethical standards involve criminal statutes. This updated (end of 2009) edition is organized by type of violations, including conflicts of interest, misuse of Government equipment, violations of post-employment restrictions, and travel.
