Available in PDF, EPUB and Kindle. Book excerpt: This book is a guide to international human rights law as it applies to situations of armed conflict, to counter-terrorism measures and to any other situation of actual or potential violence requiring security measures. These situations can lead to some of the most fundamental human rights being put in danger of being violated. These include the right to life, the prohibition of torture and inhuman or degrading treatment, enforced disappearance, all the rights relating to detention and due process of law, and the freedoms most commonly affected by armed conflict and counter-terrorism. The book begins with a presentation on the application of human rights to such situations and an explanation of the regime of limitations and derogations. After an overall description of the relationship between human rights law, on the one hand, and international humanitarian law and international counter-terrorism measures, on the other, the book concentrates on the rights themselves. Each chapter presents the relevant treaty provisions and explains the interpretation of the rights by reference to the case law and general comments of these treaty bodies. The book concludes with a section on how international human rights law protects certain vulnerable and disadvantaged populations in such situations.

Available in PDF, EPUB and Kindle. Book excerpt: This book asks whether human rights, since the 9/11 attacks and the 'war on terror,' are a luxury we can no longer afford, or rights that must always remain a fundamental part of democratic politics, in order to determine the boundary between individual freedom and government tyranny. This volume brings together leading international lawyers, policy-makers, scholars and activists in the field of human rights to evaluate the impact of the 'war on terror' on human rights, as well as to develop a counter-terror strategy which takes human rights seriously. While some contributors argue that war is necessary in defense of liberal democracy, others assert that it is time to move away from the war model towards a new paradigm based upon respect for human rights, an internationally-coordinated anti-terror justice strategy, and a long-term political vision that can reduce the global tensions that generate a political constituency for terrorists.

Book excerpt: In this book, it is explained that despite a current drop in the number of deaths, terrorism should still be considered a serious and widespread problem. However, the responses to this phenomenon are often more problematic from a long-term perspective. With the human rights framework under serious pressure, this edited volume offers a timely, important and critical in-depth analysis of human dignity and human security challenges in the lead-up, and in the responses, to current forms of terrorism. It aims to map how human dignity and human security can be secured and how law can constitute a source of trust at a time when Europe and the rest of the world continue to be plagued by terrorism. The authors are both established names and upcoming talent in this fastchanging and exciting field of law. They thoroughly analyse a variety of topical subjects, in more conceptual chapters—for example calling for the humanisation of the security discourse—and in highly practical contributions, in which for instance the Kafkaesque situation in which rendition and torture victim Abu Zubaydah still finds himself today is considered. This book, which focuses on, but is not limited to the situation in Western countries, aims to inspire not only academics—through further theorisation on the sometimes elusive but important concepts of human dignity and human security—but also practitioners working in the field of countering terrorism. It will hopefully convince them (even more) that following a human rights approach will be indispensable in securing human dignity and human security for all. Even—or in fact: especially—in times of terrorism. Christophe Paulussen is a Senior Researcher in the Research Department of the T.M.C. Asser Instituut in The Hague, The Netherlands and Martin Scheinin is Professor of International Law and Human Rights in the Department of Law of the European University Institute (EUI) in Florence, Italy.

Available in PDF, EPUB and Kindle. Book excerpt: This book reinforces our knowledge and understanding of the problems involved in balancing human rights protection and security concerns, considering how these human rights issues have been raised by the various international debates and policy issues which have been created by the continuing global war on terrorism. In the shadow of 9/11 the threat of terrorism is an ever increasing global preoccupation. Terrorism and Human Rights discusses the effects of the legal and social aspects of terrorism by examining the relation between security issues and human rights from the angle of international organizations, political bodies and different countries. Some of the examples covered and which are examined in light of their approach and reaction to terrorism include the European Union, the UN, Russia and the United States. Previously published as a special issue of Terrorism and Political Violence, this volume will be useful for all students of security, politics and terrorism studies, but also for policy makers, legislators, and law enforcers.

Available in PDF, EPUB and Kindle. Book excerpt: This book aims to improve understanding of the broad trends in the utilisation of political violence by examining the use of state terror in world politics. The ending of the Cold War and the overthrow of communism in Eastern Europe led many to assume that this presaged the demise of the one-party terror regime and acceptance of Western concepts of democracy, freedom and human rights throughout the international system. But of course this did not end state terror. The totalitarian one-party state still exists in North Korea and China, and there are numerous military regimes and other forms of dictatorship where the use of terror techniques for internal control is routine. The late Professor Paul Wilkinson conceived and began this project with the intention of analysing the major types of international response to state terror, as well as their outcomes and their wider implications for the future of international relations. In keeping with this original premise, the contributors explore the history of terrorism, as well as reflecting on the need for international cooperation based on the protection of civilians and a consistent approach to intervention in conflict situations. This book will be of much interest to students of terrorism studies, political violence, human rights, genocide, and IR in general.

Book excerpt: In recent years, there has been much controversy about the proper forum in which to prosecute and punish suspected terrorists. Some have endorsed aggressive use of military commissions; others have proposed an entirely new "national security court." However, as the nation strives for a vigorous and effective response to terrorism, we should not lose sight of the important tools that are already at our disposal, nor should we forget the costs and risks of seeking to break new ground by departing from established institutions and practices. As this White Paper shows, the existing criminal justice system has proved successful at handling a large number of important and challenging terrorism prosecutions over the past fifteen years-without sacrificing national security interests, rigorous standards of fairness and due process, or just punishment for those guilty of terrorism-related crimes.
