Book excerpt: Excerpt from Handbook of the Law of Sale of Goods The Sale of Goods Act, 1893, by which the law relating to the sale of goods was codified in the United Kingdom, has now been adopted, with slight modifications, in all the provinces of Canada except Quebec, the process of adoption having been completed by the enactment in Ontario of the Sale of Goods Act, 1920. Prior to the adoption of the stat ute there existed, especially in Ontario, a considerable body of case law. This case law is of course now authoritative only so far as it is consistent with the statute; but for the most part they are' in accord with each other, and the de cisions furnish useful illustrations of the statute. The arrangement of the statute is followed in the main, but in some respects the scheme of the book has necessitated some change in the order of the statutory provisions. The design of the book is to make the statute more readily avail able and more useful in Canada, and references are given to a relatively large number of recent English and Canadian cases. The alphabetical index is supplemented by an unus ually full table of contents, and the comparative table of section numbers will, it is hoped, enable a reader readily to compare the statute in force in one province with that in force in any other province or in the United Kingdom. Book excerpt: Excerpt from Hand-Book of the Law of Sales The object of this handbook is to present concisely the general principles of the law of the sale of personal property. The arrange ment is in the main that of Benjamin. The statement of rules and principles in the black-letter text has to a considerable extent, though with many modifications, necessitated by the difierences between the American and English law, or by other reasons, been taken from the English Sale of Goods Bill, as drafted by his Honor, Judge Chalm ers, and published together with his invaluable notes under the title of The Sale of Goods. This bill, which was purely a codify ing measure, has since been substantially enacted as An act for codifying the law relating to the sale of goods (56 57 Vict. C. 71; February 20, The writer has made frequent use both of the notes of Judge Chalmers and of the text of Benjamin on Sales. The references to Benjamin are to the sections as found in the sixth American edition, of Messrs. Edmund H. And Samuel 0. Bennett. Book excerpt: Excerpt from The Trader's Guide to the Law Affecting the Sale of Goods The law relating to the Sale of Goods has been codified by the Sale of Goods Act, 1893, and according to its learned draughtsman (mr. M. D. Chalmers), the object of this statute is to lay down rules when the parties have either formed no intention, or failed to express it. Moreover, the Act seeks to set out in one consistent whole the entire mass of law relating to its subject matter; that is to say, it endeavours to combine common law (judicial decisions) and statute law. But though the law has been codified by this enactment, yet the common law, as laid down by the judges, loses none of its force. The primary object which the draughtsman had in view in framing the Sale of Goods Act, 1893, was to substantially reproduce, in statutory shape. Book excerpt: Excerpt from The Law of Sales of Personal Property The provisions of the Statute of Frauds, bearing upon the sale of goods, have been treated in connection with the common-law topics to which respectively they relate. It is believed that this method has resulted in an economy of space in the book, and will conduce to a like economy of time and perplexity on the part of the student. Book excerpt: Excerpt from The Roman Law of Sale: With Notes and Illustrations; Digest XVIII. 1 and XIX. 1 Translated; With Notes and References to Cases and the Sale of Goods Act Advantage has been taken of the Opportunity to recast several of the notes (especially those headed by a thick rubric), and to add some new ones, in order to give a somewhat more complete view of the subject. The law on two or three matters essentially connected with the contract, though treated under distinct Titles in the Corpus Jam's, has been summarised in an Appendix which is wholly new. A commentary on a text so loosely put together and so full of repetitions must necessarily be somewhat inconsecutive; it is hoped that the numerous cross-references and a very full Index will supply the necessary connecting links. Book excerpt: Excerpt from The General Principles of the American Law of the Sale of Goods, in the Form of Rules With Comments and Illustrations: Containing Also the English "Sale of Goods Act" The form of this work is similar to the one published by me in 1889 entitled Principles of Contract. That work was an attempt to state methodically, in concise language, the fundamental principles of contract. The statements are in the form of rules (in the nature of a code), followed by such comments and illustrations as seemed suitable to bring out clearly the import of each proposition; and each proposition is supported by the authority of adjudged cases, selected with a View to force of reasoning and pertinency of illustration. Book excerpt: Excerpt from The Law of Agency IN writing this handbook on the Law of Agency I have adopted the plan of stating the law which governs the subject, in a series of concise rules, supported in the text by the decided cases upon which those rules are founded. In doing this I have departed from the usual practice of merely giving references to cases in footnotes: my object being not only to provide the reader with a number of references, but also to set out for him in the text such extracts from the cases themselves as seem necessary to support and illustrate the rules and principles laid down. In the Appendix will be found the Factors Act, 1889 (52 58 Vict. C. And Part IV. Of the Sale of Goods Act, 1893 (56 57 Vict. C. Which, together with the various sections of Statutes which I have found necessary to introduce into the text, will, I think, comprise all the Statutory Law which bears upon the subject. I trust that, ' by adopting this arrangement, I shall render my book useful, not only as a work of reference for practitioners, but also as a guide to students of the Law of Agency.
