Book excerpt: Kenya is one of about 42 African countries which have enacted framework environmental laws. 14 January 2000 was the Date of Commencement of the Environment Management and Co-ordination Act (EMCA) after its adoption in December 1999 and receipt of Presidential Assent on 6 January 2000. From that date, all sectoral laws were expected to be reviewed or amended to ensure consistency with the requirements of EMCA. Under Section 148 of EMCA: "Any written law, in force immediately before the coming into force of this Act, relating to the management of the environment shall have effect subject to modification as may be necessary to give effect to this Act, and where the provisions of any such law conflict with any provisions of this Act, the provisions of this Act shall prevail". This book is an appraisal of the extent to which this provision has been implemented. It critically analyses environmental law in Kenya with a view to identifying the convergences and divergences between select sectoral laws and EMCA. The ultimate objective is to support internal harmonization of the corpus of environmental law in Kenya.

Available in PDF, EPUB and Kindle. Book excerpt: A unique publication that examines emerging and cutting-edge environmental issues from no less than seven countries including Africa and China. These issues are examined mainly from a trans-disciplinary environmental governance perspective that includes law, ecology, economics, policy and management. The contributors to the book include some exceptional young scholars. They, together with other contributors who are distinguished environmental legal experts, have advanced the scholarship of environmental governance. Koh Kheng-Lian, National University of Singapore This timely volume provides fascinating insights into emerging developments in the field of legal governance of the environment at a time when environmental governance is increasingly concerned with far more than legal doctrine. The expert contributors are concerned with the totality of arrangements through which power and resources are deployed to protect and restore natural resources, and how the costs and benefits of this are allocated. They explore key issues such as: how the community exercises its democratic rights; how government responds to the needs of current and future generations and balances the interests of the powerful with the powerless; the freedoms and responsibilities of commerce and the holders of property; and the ways in which laws and policies are informed by science and other perspectives. The various ways in which legal scholarship is pivotal to good governance are thus highlighted, as is the extent of innovation being generated by current ecological, economic and social challenges. Clearly demonstrating the increasing breadth and depth of environmental law scholarship, this thought-provoking book will prove an invaluable reference tool for academics, students and researchers focusing on environmental law and development.

Available in PDF, EPUB and Kindle. Book excerpt: We live in an era of human-dominated ecosystems in which the demand for environmental governance is rising rapidly. At the same time, confidence in the capacity of governments to meet this demand is waning. How can we address the resultant governance deficit and achieve sustainable development? This book brings together perspectives from economics, management, and political science in order to identify innovative approaches to governance and bring them to bear on environmental issues. The authors' analysis of important cases demonstrates how governance systems need to fit their specific setting and how effective policies can be developed without relying exclusively on government. They argue that the future of environmental policies lies in coordinated systems that simultaneously engage actors located in the public sector, the private sector, and civil society. Governance for the Environment draws attention to cutting-edge questions for practitioners and analysts interested in environmental governance.
