Book excerpt: Addressing the interests of non-human animals in an era of globalization requires consideration of a wide range of international influences upon domestic case law, policy, and legal doctrine. International agreements and decisions affect much more than simple cross-border transactions in animals or animal-related products and can also impact what individual countries may or may not do internally to address animal cruelty, health, consumer protection interests, cultural preservation, conservation, species preservation, and a host of other issues in their national laws and regulations. For the first time, materials from a variety of sources are brought together in a single volume which permits instructors and students to focus directly on the complex interaction which occurs between domestic animal law and various international regimes. Key multilateral environmental agreements, such as the Convention on Biological Diversity, the Convention on Trade in Endangered Species, and the International Convention on the Regulation of Whaling, are all considered. The need for state intervention to ensure the humane treatment of non-human beings becomes evident from the economic analysis of animal welfare: Market failures such as asymmetric information, externalities, and public goods lead to a race to the bottom in terms of animal welfare standards which entails a reduction in the overall human utility. Since economic phenomena are not hindered by jurisdictional borders, states are inclined to design regulations in a way that they cannot be undermined by cross-border trade. Such measures are e.g. designed as import bans, production standards, differentiated taxes and tariffs, labeling, subsidies, or restrictions on transit. These policies in turn evoke compatibility issues with regard to international trade law obligations. The above mentioned measures are found to be in conflict with the General Agreement on Tariffs and Trade as well as several other WTO Agreements (Agreement on Agriculture, Agreement on Sanitary and Phytosanitary Measures, Agreement on Technical Barriers on Trade). Furthermore, the justification of animal welfare related policy measures by invoking the general exception clause of the GATT (Article XX GATT), poses a challenge. Therefore, several approaches to reconcile trade and animal welfare concerns are presented. The most promising solution from a legal, political, and ethical perspective is the development of an international animal welfare labeling scheme. On the one hand, such a policy increases market efficiency due to better informed purchasing decisions. On the other hand, it facilitates international trade by harmonizing diverging national measures.
