Book excerpt: This book explores the question: How did the rabbis of the first two centuries CE approach bodies that are born with variant genitals—bodies that they could not identify as definitely male or female? The rabbis had constructed a system in which every behavior was governed by one’s sex/gender, posing a conundrum both for people who did not fit into that model and for the rabbinic enterprise itself. Despite this, their texts contain dozens of references to intersex. And the Sages Did Not Know examines the rabbis’ legal texts and concludes that they had multiple approaches to intersex people. Sarra Lev analyzes seven different rabbinic responses to this conflict of their own making. Through their rulings on how intersex people should conduct themselves in multiple circumstances, the early rabbis treat intersex people as unidentifiable males or females, as indeterminate, as male, as non-gendered, as sui generis, as part-male/part-female, as a sustainable paradox, and, finally, as a way for them to think about gender, having nothing to do with intersex people themselves. This is the first such work that concentrates primarily on the potential effects of these rabbinic texts on intersex persons themselves rather than focusing on what the texts offer readers whose interest is rabbinic approaches to sex and gender or gender diversity. Although the rabbinic texts do not include the voices of known intersex people, these materials do offer us a window into how one small group of people approached intersex bodies, and how those approaches were both similar to and different from those we recognize today.

By ranging across all these societies, Levin is able to fulfill three basic aims: to delineate the general character of sexuality among the Orthodox Slavs, to enrich that account by drawing our attention to regional variations in the sexual mores of these peoples, and to draw suggestive comparisons between the world of the medieval Orthodox Slavs and their contemporaries in the Latin West. Levin begins with a study of the ecclesiastical image of sexuality as expressed in didactic and literary texts, showing that the Orthodox Church was deeply suspicious of sexuality. Her second chapter, on canon law and marfiage, examines the conditions for marriage, divorce, and remarriage, the obligation of the conjugal relationship, and the impact of these rules on social order. Levin looks at church regulations concerning sexual relations among relatives by blood, marriage, spiritual kinship, and adoption in Chapter Three, and she devotes Chapter Four to prohibited sexual practices, both inside and outside of marriage. In the fifth chapter she studies Russian and South Slavic responses to rape, and demonstrates that these societies simultaneously censured violence against women and sanctioned the attitudes and social structures that justified it. Butler - in which the Supreme Court identified pornography as an issue of sex discrimination - applies to pornography intended for a lesbian or gay male audience. The Court held that it did, finding that, like heterosexual pornography, same-sex pornography also violates the sex equality interests of all Canadians. Christopher Kendall supports this finding, arguing that gay male pornography reinforces those social attitudes that create systemic inequality on the basis of sex and sexual orientation - misogyny and homophobia alike - by sexually conditioning gay men to those attitudes and practices. The author contends that as a result of litigation efforts like those brought by lesbian and gay activists in the Little Sisters case, the notion of empowerment and the rejection of those values that daily result in all that is anti-gay have been replaced with a misguided community ethic and identity politic that encourages inequality. This is best exemplified in the gay male pornography defended in Little Sisters as "liberation" and "central to sexual freedom." Gay Male Pornography rejects the equality claims of gay male pro-pornography advocates and argues that there is little to be gained from sexualized conformity.
