Book excerpt: Historic preservation, according to the Congressional Research Service, "is the practice of protecting and preserving sites, structures, objects, landscapes, and other cultural resources of historical significance." Although state and local government programs, along with privately financed undertakings, support and bolster historic preservation, it is mainly the federal government's role through enacting legislation, appropriating funds, and administering programs through various federal agencies that contributes to historic preservation policy. Although this historic preservation policy was not officially implemented until the early 1900s, several early efforts came about in the latter 1800s. One of the first efforts by the U.S. Congress was legislation to protect "ancient Puebloan sites in the American Southwest" and then came the acquisition of "thousands of acres of private land to establish five Civil War national battlefield parks" which the then Department of War would oversee. However, in the 1850s, there was a movement to protect Mount Vernon, George Washington's home; when the federal government refused to buy the property, the Mount Vernon Ladies' Association raised the money to buy the property and protect it, thus preserving it for historical purposes. This legal research guide undertakes to highlight early federal historic preservation legislation, including the Antiquities Act of 1906 and the Historic Sites Act of 1935, along with the 1916 establishment of the National Park Service (under the Department of the Interior) for the management of public services and national monuments, as well as the creation of the National Trust for Historic Preservation in 1949 to help expediate the public to preserve building, sites and object of national importance.--Publisher.
